摘　　要：部分国家或地区地下空间开发利用管理具有相对完善和系统的法律体系。上海市城市地下空间开发利用管理法制是分散的、不是很完备,影响了上海市城市地下空间开发利用。在国家层面的法律没有制定之前,上海市应该采取必要的措施,制定相应的地方规章或地方性法规,推动城市地下空间开发利用管理的法制建设。Some countries have a comparatively complete law system for underground space development. The utilization of underground space laws in Shanghai are not concentrated or complete, thus to some extent affecting the utilization and development of underground space in Shanghai. Before the national legislation is accomplished, Shanghai is supposed to take necessary action and make local regulations and rules to push forward the construction of legislation for the utilization of underground space.
