摘　　要：党的十六大提出了构建社会主义和谐社会的目标,构建和谐社会就要妥善地处理各种社会矛盾。公安机关办理刑事案件中的调解在解决社会矛盾、维护社会稳定中有着特殊的地位和作用,但目前这方面的立法却很不完善,实际运行中亦存在一些问题,应从立法和实践两个方面对其进行探讨,以充分发挥其在构建和谐社会中的作用。The Sixteenth National Congress of the Communist Party of China has put forward the goal of constructing a socialist harmonious society, and the construction of a harmonious society needs to deal with all kinds of social conflicts properly. The mediation in the course of dealing with criminal cases has a special position and function in resolving the social conflicts and maintaining the social stability. However, the legislation in this aspect still has faultiness, and the problems still exist in the practice. It should be discussed in both legislation and practice so as to make it function well in the construction of a harmonious society.
