浅析体育自治及其对司法介入的排除

摘　　要：文章简要介绍了体育自治的理论背景和实践情况,以及体育纠纷对司法介入的排除。首先对体育自治作了初步的定义,并从规则自治、组织自治和纠纷自治三方面对目前体育自治在中西方国家的现状作了一些分析,对体育自治的基本要素进行了归纳。其次,通过对国内体育自治立法滞后的原因分析和国外体育自治立法的介绍,将国内外体育自治的立法状况作了比较。第三,通过分析近年来国内出现的具代表性的体育案例,结合国际权威体育组织的有关章程,总结了体育自治对体育纠纷解决机制的影响,并详细介绍了国内体育纠纷解决的现状和国外体育纠纷解决的惯例及机构。The chapter is about the theoretical background of the sports autonomy and its actuality, characteristics and legislation factor in China and western countries. First, by making the definition of sports autonomy and analyzing the actuality of it in China and western countries from the viewpoint of legislation, administration and arbitration, induces the essential factor of sports autonomy. Second, by analyzing the cause of lagged legislation in China and introducing the legislation for sports affair in western countries, we compare the legislation for sports affair between China and western countries. Third, by analyzing the typical cases in China, combining international sports organization＇s constitution, summarize the infection of the sports autonomy to the rule mechanism of sports dissension, and then present the circumstances of rule of sports dissension in China and those in western countries.
