摘　　要：对于环境保护,经济学家们往往基于一种理性人的假设,主张适用庇古税和排污权交易来达到环境保护的目的。这样,经济学家们往往忽视了环境保护中的人本思想。因此,我们提出了一种量变与质变相结合的多元治理结构来保护环境。而且,质变阶段的环境刑法保护手段是不可缺少的,也是需要完善的。Baced on the hypothesis of ration, economists claim to use pigovian tax and marketable pollution permits to protect the environment however, the application of humanistic theory is neglected. So, we expound the multiple structural transformation concerning the quantitative transformation and qualitative transformation. What is more, penal law is necessary and to be integrated in the stage of qualitative transformation.
