摘　　要：当前农村土地集体所有制存在着法律与现实的悖论,因当前集体土地所有权同民法理论和物权法理论激烈冲突而处于尴尬处境,比较学界对农村土地集体所有制改革方案的建议,集体土地所有制进化的模式将是从“保留集体所有制,完善使用权制度”渐进到“与各地不平衡生产力相适应的复合型多种所有制结构”,而这是和中国“渐进式”改革道路密切相连的。There exist contradictions between laws and reality in terms of rural land collective ownership.The current land collective ownership is in conflict with civil law theory and possession theory.Comparing proposals in reforming rural land collective ownership,this paper puts forward the evolution mode: from the 'keep collective ownership and perfect the system of use' to 'a multiple ownership structure in line with the unbalanced productivity in different regions'.This evolution mode closely complies with China's gradual reform concept.
