摘　　要：虚拟财产应按照什么法律体系保护一直以来都是学界研究的热点和难点,从权利的类型化分析角度,比照物权立法的模式更有利于确保财产安全,维护虚拟财产交易稳定。由于虚拟财产的债权物权化属性,客观上要求在立法中既要考虑到虚拟财产的非有形体的“物”以及网络科技的影响性,又要兼顾到物权法基础理论的融通性,通过物权立法的完整体系,并借助于物权立法技术,使虚拟财产的法律保护拥有一个完整的机制。Since the virtual property should defer to any legal framework protection always all is the educational world research hot spot and the difficulty, from the right typed analysis angle, is more advantageous according to the real right legislation pattern in guaranteeing the property security, maintains the virtual property transaction to be stable. As a result of the virtual property creditor＇ s rights real right attribute, on is objective requests in the legislation both to need to consider must has the physique to the virtual property ＂the thing＂ as well as network science and technology influenced, and must give dual attention to the reality of laws basic theory allows temporary credit the nature, through the real right legislation complete system, and draws support the real right legislaion technology, enable the virtual property the legal protection to have a complete mechanism.
