环境民事侵权应适用惩罚性赔偿原则

摘　　要：随着经济的发展,环境污染出现加剧的趋势。传统的环境侵权赔偿制度的局限性,已不能规制某些恶意的环境污染者,因此,在传统民法理论的基础上和框架内,有必要实行环境民事侵权应适用惩罚性赔偿原则。on the developing of economy, the environmental pollution becomes more and more serious. As there are many shortcomings in traditional civil power reparations institutions, the polluters can not be punished effectively. Therefore, we propose in the article that punitive principle should be used in infringement of environment civil fight on the foundation and in the frame of traditional civil law theory.
