摘　　要：从合约精神及行政法学的角度对PPP合同的合同性和行政性进行了研究和探讨,并以台湾BOT项目、深圳梧桐山、香港东区海底隧道为例进行了剖析,探讨了PPP合同应该遵循的原则,对PPP模式在我国基础设施中的应用有重要的参考价值。Based on the theory of contract and administrative law, a thorough research is conducted to contractual and administrative attributes of PPP procurement model. Several Cases, such as BOT-type projects in Taiwan, Wu Tong Shan Tunnel in Shenzhen and Eastern Harbor Tunnel in Hong Kong,are described and analyzed, and then PPP contract principles are drawn out in this paper. These findings could be beneficial to the application of PPP model in infrastructure in China.
