摘　　要：传统法律关系理论和法律关系新论都存在某些方面的缺陷。“公共信托”理论为解决传统法律关系理论和法律关系新论的不足开拓了全新的视角。以“公共信托”理论构筑的法律关系理论更具有合理性。Both traditional legal relation theory and new legal relation theory have some defects. The ＂social entrust＂ theory opens up a new orientation to deal with the defects of traditional and new legal relation theories. Legal relation theory which is rebuilt under ＂social entrust＂ theory will be more reasonable.
