摘　　要：集体土地所有权的性质界定是完善集体土地所有权制度的关键所在,在对集体土地所有权性质具有代表性的8种理论观点综述基础上,对其进行了客观的评析,结论是8种观点都存在或多或少的缺陷和不足,不能成为集体土地所有权完善或重构的理想选择。笔者认为集体土地所有权之性质应为农民集体享有的单独所有权,法律应赋予农民集体之特殊民事主体法律地位,这必将为完善集体土地所有权制度提供前提条件和打下坚实基础。Character regulation of collective land ownership is the key to perfect collective land ownership institution. Based on the eight representative viewpoints summary, the author objectively analyzes the character and cames to a conclusion that the eight viewpoints has more or less defect or shortage which can not become an ideal choice to perfect or reconstruct collective land ownership. The author insistes that the essence of collective land ownership should be the solo ownership enjoyed by farmer collectivity and the law should endow it a legal status of special civil subject, which will inevitablely establish a solid fundament for improving collective land ownership institution.
