摘　　要：先决问题不仅出现在适用内国国际私法的过程中,在适用国际统一冲突规范时,同样会出现先决问题。条约中的先决问题可以区分为狭义的先决问题和广义的先决问题,对狭义先决问题要根据准据法原则处理,对广义先决问题的处理,还要再进行区分,根据不同情况加以处理。Preliminary question is not only arisen in the process of application of domestic conflict law, but in the process of application of international unified conflict rules. The expression ＂Preliminary question＂ in conventions is itself divided into narrow sense and broad sense. The preliminary question based on narrow sense will be dealt with the application of applicable law. But for the preliminary question based on broad sense, it＇ll be dealt with varied kinds of ways according varied circumstances.
