摘　　要：《中华人民共和国反垄断法(草案)》已提交审议,其中第2条、第44条、第50条有一个共同表述,即“有关法律、行政法规另有规定的,依照其规定”。本文认为这一表述无论从立法技术、法律逻辑,还是现代法制理念上都值得商榷。法条中的“另有规定”不仅削弱了反垄断法的权威性,而且还降低了其作为“经济宪法”的法律地位。The purpose of this paper is to analyze Article 2, Article 44, and Article 50 of the Draft Chinese Anti-monopoly Law. With the development of society, the exemption systems of antimonopoly law are developing. In establishing Anti-monopoly Law, China should be practical and realistic, taking into consideration the developments of other countries, and drawing on their experience.
