摘　　要：法律概念是民法典体系构成的基本细胞。法律概念具有规范性、抽象性、确定性中带有较大程度的模糊性、含义的专门性、价值性的特点。法律概念在体系构成中,具有重大的作用。但其作用的发挥需要发展成为法律类型,同时也需要法律原则的平衡与统率。Legal concept is the basic cell which constitutes the civil code system. Standardization, abstraction, valuableness, specialization of connotations and the obscurity buried within certainty are all features of the legal concept. Legal concept plays an important role in the system constitution. However, it is a necessity for it to be developed as a legal type so as to exert its function. Meanwhile, the balance and guidance of the legal concept is also necessary.
