摘　　要：文章在综合分析的基础上指出,高等教育合同有其特定的含义,其在本质上是民事合同,应归入民法范畴,亟待在《合同法》中明确规定高等教育合同一章,从而对高等教育合同进行有效的规范与调整。On the basis of comprehensive analysis, the author thinks that the higher education contract has its own definition . Es sentially , higher education contract is the civil contract. In view of the law reality of the higher education contract , it is necessary to rule definitely the chapter of higher education to make a good norm and regulation on higher education contract.
