摘　　要：西方法治理论的发展经历了“良法之治”“形式法治”“实质法治”三个阶段。中国的法治建设应走实质法治的道路,但需要通过完善一系列形式性的法律制度来推动。The theory of rule by law in the West has experienced three stages, which are ＂rule by good law＂, ＂formal rule by law＂ and ＂substantive rule by law＂, each of them having its own strengths and shortcomings. The construction of rule of law in China should choose the path of substantive rule of law, but to impel its advance, a series of formal law systems also need consummating.
