论唐代保辜制度的完善及其立法借鉴

摘　　要：保辜制度是中国传统法律中一项独特的法律制度。它在中国延续几近千年,在中华法系中发挥着重要作用。本文认为,至唐代保辜制度正式入律,并且已经具备了很强的可操作性,并在实践中引入了比较完善的保人担保制度,从而使唐代的保辜制度从立法到司法都取得了较高的成效。而保辜制度的实施对人际关系修复的效果对我们今天的立法思维具有重要的借鉴意义。The Baogu system was a unique one a part throughout the history. The author makes a Baogu system taking in Chinese ancient statute, having great functions as superficial research and analysis on Tang Dynasty＇s it into its evolution, different from the view of jurisprudence and logic of most of investigators. It points out that it is in Tang Dynasty that the Baogu system was drawn into statute formally. With the introduction of assurance system it made more achievement from legislation to judicatory than past.
