摘 要:“城中村”改造是事关城中村村民、村集体经济组织、地方政府、房地产开发企业等多方主体利益的一场社会改革,不同的改造模式的法律选择决定着诸主体在城中村改造中的不同法律地位和作用,特别是城中村村民利益诉求实现的程度。目前我国城中村的改造模式主要有政府改造、村民自我改造、半市场化改造和市场化改造等模式。通过对不同模式的法律辨析,认为以村民、开发商为主体的半市场化改造模式是城中村改造模式的最佳选择。The reconstruction of village-in-city is one of the social reforms leading by the local government and involving various subjects, such as villagers, the village organization of the collective ownership, and the real estate limited-liability company. The choice for the mode of the reconstruction of village-in-city can determine not only the different legal position and role of the subjects involved in, but also the different interests of them. There are four kinds of modes of the reconstruction of village-in-city now, such as the mode of reconstruction by local government, the mode of reconstruction by villagers, the mode of reconstruction by villagers and business firm, and the mode of reconstruction by the business firm. Through the legal analysis of the various modes of reconstruction, the writer herself thinks that the best way to reconstruction is to carry on the mode of rebuild by villagers and the business firm.
