摘　　要：古代量刑原则,是古代国家审判机关在量刑时必须遵循的基本准则,它规范着整个量刑活动。中国古代量刑有三大基本原则:以犯罪事实为根据、以刑事法律为基本准绳的原则,疑罪从轻原则和罪刑相适应原则。Chinese ancient principle of punishment is the basic principle which is obeyed by a judge to decide the punishment. It restricts the whole punishment. In this article, the author thinks there is three basic principles of Chinese ancient punishment according to correlate ancient documents-the principle of being based on the criminal acts and criminal law, the principle of suspicious criminal acts being given a lighter punishment and the principle of suiting punishment to crime.
