摘　　要：夫妻“空床费”纠纷诉诸法院的报道曾经引起广泛讨论。“空床费约定”是情谊行为而非法律行为,虽有形式上的“合意”,但因欠缺拘束力和执行力而不构成债的关系。法律对两性、家庭等关系的调整,应当与其他社会关系的调整策略有区别,避免过度干预,才能收到较好的社会效果。The reports on the action caused by night - absence pay dispute between spouses have been widely discussed. The agreement of night - absence pay is helping act rather than juristic transaction. It formally makes a meet of mind; however, it does not form a relation of obligation because the agreement is not binding and executable. The method of law adjustment of families, sexes and similar relations should be different from other social relations. The void of excess interventions of law in this field may bring about better social effects.
