论危险增加通知义务的履行

摘　　要：被保险人在履行危险增加通知义务时,应当将保险合同履行过程中发生的显著、持续增加的危险状况通知给保险人,这种增加是保险人在订立合同时所估计不到的;投保人应当与被保险人同样负有危险增加的通知义务;投保方依据保险单中规定的方式履行通知义务,如果保险条款规定以书面形式履行,保险人应当就此条款在订立合同时向投保方说明;投保方适当履行通知义务,在保险人没有做出选择救济方式之前危险增加的事故发生,应当根据危险增加的原因判定保险人是否承担保险责任。The insured should inform the insurer of the significant and constant increase of risks in the execution of the insurance contract when fulfilling the notification obligation for risk increase, Such risk increase cannot be anticipated by the insurer when setting up the contract, The insurance applicant has the same risk increase notification obligation as the insured person and should use the method of notification as specified when setting up the contract, The insurer should specify the notification method to the applicant if the contract requires such notification to be made in writing. In case that the increased risk occurs before the insurer makes decision on remedy method after being properly notified by the applicant, the reason of risk increase should be considered in deciding whether the insurer should be held liable.
