摘　　要：鉴于非物质文化遗产的脆弱性与复杂性,以法律保护非物质文化遗产显得非常必要和迫切。本文分析了我国制定法在保护非物质文化遗产中所取得的成就和存在的问题,阐述了民间规则保护非物质文化遗产的可能性,提出应当加强非物质文化遗产的私法立法并应挖掘和研究民间规则以弥补法律的局限。As the intangible cultural heritage is fragile and complex, it is very important achievement and problem are analyzed possibility of the protection about the in in protecting the intangible cultural to protect it by law. The heritage by statute. The tangible cultural heritage by the folk regular is expounded. This article reveals that the private law of protecting the intangible cultural heritage the folk regulations should be studied deeply in order to remedy the limitation should be improved and of statute.
