公安院校纪律必要与边际——以一起公安院校学生诉母校案为例

摘　　要：近年来,普通高等学校学生诉母校案频频发生,引发诸多法律问题,其中普通高等学校制定的学生管理规定的合法性备受关注。以一起公安院校学生诉母校案的法律适用为切入点来分析公安院校校规校纪的特殊性,可以看出我国在立法层面上虽然没有对公安院校学生的思想品德、纪律要求作出统一、明确的规定,但是根据相关规定,与普通高等学校相比,国家对公安院校的学生在纪律要求上更加严格,实施偷窃行为的学生不能获得公安院校的毕业证书。In recent years, there are increasing legal cases about university students＇ legal actions against their mother schools in common institutions of higher learning, which have led to many legal problems, out of which the legality of disciplines for students＇ management established by school authorities have been paid much attention to. Here, by analyzing the particularity of public security schools＇ disciplines from a case of a public security school student＇s legal action against his mother school, we can see that although there is not an integrate, implicit discipline for students＇ ideological and moral education, requirements for rules and regulations in public security universities and colleges, according to some relevant regulations, more strict requirements are imposed upon students in public security schools by our country when comparing to students in common institutions of higher learning, for this reason, a student who commits a burglar should not obtain a certificate of graduation from a public security university or college.
