摘　　要：新型农村合作医疗制度是指由政府组织、引导和支持,农村居民自愿参加,集体和政府多方筹资为主要内容的农村医疗互助共济制度。自2003年国家进行新型农村合作医疗试点以来,在一些试点地区取得了较好的成绩,但同时也出现了不少问题,其中一个比较重要的原因就是缺乏法律保障。本文拟对新型农村合作医疗制度的立法体系和内容作初步构想。The new rural cooperative medical care system is a kind of mutual aided system organized, guided and backed by the governments. It is based on mutual voluntary participation of local people and diverse financial sources from individuals, collectives and the government. The pilot project has been initiated in rural areas with some good performances since 2003. However, some problems,including one mainly caused by the deficiency in legal protection, are emerged. This article focuses on the speculation of lawmaking system on this new system.
