海域使用论证与海洋环境影响评价的比较研究

摘　　要：从法源、主导思想、宗旨和主要研究内容等方面对海域使用论证和海洋环境影响评价工作进行了比较研究。研究表明,两者的宗旨一致,都是为了实现海洋资源、环境、经济的可持续发展,但是法源不同,所要解决的问题不同,主要内容也有很大差别。海洋资源利用的合理性分析、与利益相关者的协调、用海范围界定和面积量算等方面是海域使用论证的重点,而海洋环境影响评价的重点是分析、预测和评估建设项目对海洋环境可能造成的影响,提出环境保护措施和环境监测的建议。两项工作都很重要,任何偏颇将对我国可持续发展战略的实施带来重大的损失。Base on the data of law foundation, solving domain, ultimate goal and main study content, a comprehensive analysis is done between sea area use demonstration and marine environmental impact assessment. Results show their identical ultimate goal is to realize the overall coordination of sustainable economic and social development with natural resources and environment. However, a huge difference exists between their law foundation, solving domain and main content. The essentials of sea area use demonstration are to analyze the rationality of marine resources exploitation, the coordination among benefit interrelated unit and calculate the area of sea utilization. But the essentials of marine environmental impact assessment are to analyze and estimate the environmental impact resulting from the implemented project, and make a proposition in accordance with the measures of protecting and monitoring environment. Both two works play the same important role. If one is overemphasize or underemphasize, it will cause huge losses for the implementation of sustainable development.
