摘　　要：作为给付障碍的一种特殊形态,一时给付不能应当采取实体法解决进路,而不应当采取诉讼法解决途径。在一时不能期间,债务人的给付义务或者说债权人的履行请求权因抗辩而受到中止,即债务人的给付义务或者说债权人的履行请求权在根本上继续存在。在一时不能的情形,应当采取拟制期间的做法来认定债权人的解除权和损害赔偿请求权,而不采取不可苛求性之规则。As a special form of defaults in performance, temporary impossibility should take the approach of substantive law and not take the approach of an action. During temporary impossibility, the obligation of debtor or the performance claim of creditor are suspended by defense,also they exist continuously. In case of temporary impossibility, man should take the way of fictional time to recognize the right of rescission and the claim for damages of creditor,and not take the rule of undue hardship.
