摘 要:我国《信托法》只能规范以信托投资公司、基金公司为主体的信托关系,却无法涉及其他金融机构参与的信托关系,是目前资产管理市场上的不正常现象,并带来了市场竞争规则不一状况和要求修订规则的呼声。本文基于信托法理分析了多家金融机构提供的金融产品,认为均符合信托法律关系特征并应受到我国《信托法》的规范。《信托法》宜尽快从法律关系的性质着手而不是仅仅从主体着手来进行完善,以便使各个金融机构在混业趋势下找准自己的发展方向,监管机构亦能抓住风险源头,在保证市场公平的前提下实现《信托法》对资产管理市场开放和发展的促进作用。The existing PRC Trust Law apparently ignores the regulation on trust settled by other financial institutions except trust investment companies and mutual fund companies. This has caused certain abnormal phenomenon in the assets management market, the repugnant rules of market competition and the appeals for review and refinement of the relevant law and rules. This paper analyzes a number of financial products provided by a variety of financial institutions, and argues that these products are in conformity with the legal nature of trust and therefore should have been regulated by the Trust Law. Further, the present Trust Law should be applied on any trust based asset management products supplied by various financial institutions, especially under the trend of conglomeration and globalization.
