对供排水行业特许经营管理的思考

摘　　要：供排水行业的特许经营本质是政府加强行业管理的一项行政许可制度,虽然还没有从法律层面上加以确定,却是目前政府监管的最有效的方式。目前特许经营与供排水行业项目建设较普遍采用的BOT模式存在着混淆。BOT是招商引资的融资方式;供排水行业特许经营管理的目的是提高效率、提升服务、保障公共利益和社会效益的最大化。结合上海的实践,分析了加强特许经营管理的必要性以及规范管理的重点内容。Concession operation adopted by water and wastewater sector is a kind of administrative license system used by government for strengthening industry management. It is the most effective means for the supervision and management of government at present, although it has not been regulated by legal terms. Confusion is existed between the widely-used BOT model and concession operation. BOT is applied normally for introducing investment, however, concession aims at improves efficiency, services and protects the public interest and maximizes the social benefit. The necessity of strengthening concession operation is examined by using the case of Shanghai and key areas for regulated management are proposed.
