论我国地质遗迹资源的法律保护

摘　　要：本文通过对我国地质遗迹资源开发利用水平和立法现状进行分析,找出目前我国地质遗迹资源开发利用和立法制度中存在的问题。研究结果显示,我国地质遗迹资源开发利用水平低,立法状况不完善,与国际接轨不密切,这种状况明显对我国地质遗迹资源的保护不利。结合国外一些国家对地质遗迹资源保护的成功经验和有效的立法措施提出了一些合理的、有效的、可行的中国未来地质遗迹资源法律保护意见。The geological heritage is a kind of precious, unreproducible natural resources. It is the important physical base for human＇ s living and development. Especially in China owning the typical and diverse geological landscape, the inconsistency between human and land is very obvious and the geological heritage resources has been damaged seriously. The valid protection and reasonable utilization of the geological heritage resources become very important. This paper analyses the exploitation and legislation conditions to the geological heritage resources in our country. The result shows that the utilized extent to the geological heritage resources is low, and the legislation is imperfect, so it can＇ t be geared to the international standards. The present status is unfavorable for the geological heritage resources in China. This paper combines some successful external experience and valid legislation measures for the protection, and presents some reasonable, valid suggestions for China＇ s legislation in geological heritage resources.
