摘　　要：《多哈宣言》明确了WTO成员充分利用TRIPS协议中的弹性条款的权利,但并未解决TRIPS下药品专利权与公共健康权的法权冲突。我国应充分利用TRIPS协议中的弹性条款,通过立法协调和程序协调使其平衡,从而达到有效保护我国公共健康权的目的。Doha Declaration determines WTO members＇ right that is to make full of elastic clause in TRIPS agreement. However, it does not solve the conflict between patent right of drugs and public health right under TRIPS. China should make full of elastic clause in TRIPS agreement and make it balance through legislative coordination and procedure coordination to protect Chinese public health right.
