摘　　要：基于对国内外有关完工后质量责任的法律和工程合同的对比研究,以及对国内外房屋质量缺陷数据的定性定量分析,指出了我国目前质量责任期不明晰、保修期过长等问题.提出了我国工程完工后质量责任阶段的重构方案,以及适合我国的工程质量保证期和工程质量保险期限,为工程质量保险的开展提供了理论和实证依据.同时,在质量责任阶段重构的基础上,为当前亟待解决的保修金拖欠、农民工工资拖欠等问题,提供了解决的理论依据和途径.Based on a contrastive study of the domestic and foreign law and the project contract on quality defects liability after Practical Completion and qualitative as well as a quantitative analysis of building defects distribution, a plan is proposed to reconstruct the liability period after practical completion in China and the reasonable duration of each stage. This paper presents a theoretical and practical basis for the implementation of inherent defects insurance in China, and the solution for the currently urgent problems about the maintenance deposit and labors＇ wages in arrears.
