摘　　要：Continued offence is a controversial formation of crime in criminal theory. Continued offence must be with the state while continuing illegal. The length of time is not the unique element to identify the continued offence. Continued offence is different from situation offence.继续犯是刑法理论中存在争议较多的一个罪数形态。继续犯必须是犯罪行为与不法状态同时继续，时间继续的长短并非确定继续犯的唯一要素。继续犯和状态犯有所区别。
