摘　　要：农民工是我国社会转型时期的一个特殊群体,他们在城市社会遭遇的不公待遇与我国现行的相关立法内容与立法程序有着重要的联系。就其制度根源而论,宪法理念的缺失与宪法实施机制的缺位乃是农民工权利长期得不到有效保护的重要原因。为了加强农民工权利保护,重构我国的宪法权利体系,改革户籍制度、强化立法听证制度乃是当务之急。Migrant workers are one important group in contemporary China when the country is undergoing social transformation. However, the treatment of migrant workers receive is not very fair because of some legislative contents and proceedings. The underlying causes are a lack of constitutional concepts and constitutional enforcement implementing mechanism. So it is necessary to re-construct the constitutional rights system, reform the system of registered permanent residence and legislative hearing for migrant workers.
