摘　　要：本文提出并分析了我国现行精神病人监护制度面临的社会背景问题和制度本身问题;从借鉴的角度,介绍分析了以德国为代表的法定监护型、以英国为代表的意定监护型、以日本为代表的混合型三种典型立法模式,面向我国立法归纳总结了成年人监护制度的三大新理念和我国的五大立法选择性课题,即尊重本人的自己决定权、重视人身监护、维持本人生活平常化等新理念和制度的利用对象、立法模式的选择、法定监护的方式、意定监护、构建国家社会支持体系等课题。This thesis tries to bring into focus and analyze the problems our country faces in the guardian of psychopath, in particular the problems found in the social background and the system itself. Here the writer refers to three classical legal systems： the legal guardianship mainly practiced in Germany; guardianship by conduct practiced in Britain and the hybrid guardianship in Japan. Basing on the legislative reality, the writer summarize three new trends of legal thinking in the guardianship by adult and five legislative issues in our country, i. e., the new ideas of respecting individual decision-making right, emphasizing personal guardianship, preserving the normal life of the individual and the five legislative issues of the target of the system, the choice of legislative mode, the means of guardianship, the guardianship by conduct and constructing state and society - supporting system.
