论中美人权之争的根源与特性

摘　　要：人权问题是很长时间以来影响中美关系的一个重要因素。中美人权之争之所以长时间存在并且在某些特定时期左右中美关系的发展,其根源主要在于:中美两国在社会制度和意识形态上的不同以及在此基础上形成的不同的人权观;中美两国社会经济发展水平的巨大差异以及处于不同社会发展阶段的两个国家所强调的不同侧重点;中美文化传统的不同以及文化传统对人权观所产生的重要影响;中美不同的历史经历的深刻烙印。这些因素使得中美人权之争从某种意义上讲是不可避免的。此外,中美人权之争还具有三方面的特性,即长期性、复杂性和矛盾性。从中美人权之争的历史来看,两国的政策和做法完全不同。从目前来看,解决中美人权之争的关键在于美国方面。Human rights issue is an important factor that has influenced China- US relationship for a quite long time. The roots which make China- US human rights disputes exist for a long time and even decide the development of China- US relationship in some special periods are as follows： the differences between China and US in social system and ideology as well as different human rights perspectives based on those; big gap between Chi- na and US in levels of social and economic development as well as the different priorities on human rights; different cultural traditions and the significant impact of the cultural traditions on human rights perspectives; deep brands of different historical experiences between China and US. All these factors made China - US disputes on human rights inevitable in some sense. In addition, there are three characteristics in China- US human rights disputes, i.e. long - term, complicated and contradictory characteristics. From history of the human rights disputes, we can see totally different policies and practice between China and US. And from now, the key to solve China - US disputes on human rights lies on the US side.
