论公安机关对娱乐场所治安的监管——以新《娱乐场所管理条例》为视角  

On Public Security Organ's Supervision of the Entertainment Places——From the Perspective of Regulations on the Administration of Places of Entertainment

摘　　要：为了确保娱乐场所的健康发展,适应现代公共管理的要求,公安机关对娱乐场所治安状况的监管应当实现由“限制式”走向“服务型”,由“单中心管理”走向“多中心治理”,由“全方位”的管理控制走向“有所为”、“有所不为”治理的转变。按照新《娱乐场所管理条例》(以下简称新《条例)》的要求,公安机关对娱乐场所经营主体与从业人员的准入资格、娱乐场所的安全条件、安全管理制度与活动等进行监管,落实娱乐场所的备案制度,强化监督检查与行政处罚等工作,建立警示、警告系统,强化娱乐场所的责任意识。公安机关还要加强与文化、工商等部门之间的信息通报,形成对娱乐场所监管的合力,推动娱乐场所的健康发展。To ensure the healthy development of entertainment places and to adapt to the modern requirements of public management, the role of public security organ＇s supervision on the entertainment places should change from constraint type to service type, from central management to multi-central management, and from overall control to necessarily part control. According to the requirement of new regulations, public security organs shall supervise operational subjects, qualification access of the employers, security condition of the entertainment places, security management system and activities. And public security organs shall carry out record-filing system, consolidate examination and administration penalty, establish warning system and strengthen the liability awareness of the entertainment places. Public security organs should also strengthen information notification with cultural and industrial and commercial departments. The joint efforts can be formed to enhance the healthy development of the entertainment places.
