摘　　要：人是自然环境的产物。人类对自然的破坏就是对人类自身生存环境的破坏。工业化在空前增进人类财富的同时,也制造了空前的环境危机。环境权正是这种环境危机和对环境危机反思的产物。国际社会为保护生态环境和确立作为一项新型基本人权的环境权,付出了持续的努力,取得了很大的共识。中国自古就有敬天保民、天人合一的宇宙观。但在追求工业化进程中,中国的自然环境遭到了严重的破坏。农民的生存环境日益恶化,亿万农村人口尚生活在有害的环境中。确立以环境权为中心的环保理念,尽快改变农村恶化的生态环境,确保每一个人生活在健康、安全和舒适的环境中,是当代中国一项十分迫切的时代课题。Human being is the product of natural environment. The destruction to nature by human beings is the destruction of their own living environment. Industrialization has produced unprecedented environmental crisis while it is immensely building up human wealth. The enviromnent right is precisely the outcome of the envioronmental crisis and the reflection on it. The international Community has paid persistent efforts and formed great common understanding for protecting ecological environment and establishing enviromental night as a new basic human right. Since ancient times, Chinese have shaped the world outlook of respecting heaven, prosper people and the unity of heaven and human beings. While in the process of industrialization, the natural envitonment of Chine has been seriously dameaged, the living environment of peasants is deteriorating day by day. Hundreds of millions people are living in harmful environment. Thus it has become an exigent time topic of contemporany China to establish the concept of environmental protection which takes environmental right as its center, to change the deteriorating ecological environment as soon as possible, to ensure that everyone lives in healthy, safe and comfortable environment.
