摘　　要：隐私权和知情权是公民的两项基本的权利。隐私权是一种消极的、被动的权利,而知情权是一种主动的、进攻性的权利。隐私权与知情权之间存在着反向的关系,隐私权的范围越大,知情权的范围越小,两者不可避免地在许多领域中存在着冲突。本文从医疗行为中临床、教学、科研及其他特殊医疗行为三个方面分析了隐私权与知情权的法律冲突的表现形式及原因,并针对这些具体冲突,提出相应的解决办法,以期达到二者利益的最大平衡。Privacy right and informed consent right were two basic rights for citizens. Privacy right was a passive and negative right, informed consent right was a active right. Privacy right and informed consent right had an opposite orientation. The larger scope of privacy right, the less scope of informed consent right had. So they conflicted in many fields. The article analyzed the form and reason of conflict between privacy right and informed consent with the views of clinic service, teaching ＆ research and other special medical service. Some suggestions to balance them were discussed.
