摘　　要：认为弹性生产力组织方式是未来中国建筑业的应然选择。但是该制度设计的基本条件,包括法定企业生存空间和弹性的总、分包模式,还存在法律上的困境与责难,应予以修正。Authors of this paper approve that flexible productive forces is an inevitable choice for construction industry in China. But there are still legal predicament and difficuhiy in the basic condition of this model, which including statutory enterprise＇s exist scope and flexible model of general contract and subcontract, it should be amended.
