建立法制主导型中国离岸金融中心的研究

摘　　要：国际离岸金融中心的建立和发展分为自然形成型和政策推动型两类,对经济发展的推动作用也各有差异。采用政策推动型离岸金融中心模式的国家,在发展过程中暴露出行政权力膨胀、滥用,行政监管变成管制或者庇护等弊端。因此,中国在建立以金融法制主导的政策推动型离岸金融中心时,应当保持金融法制的中立地位,运用金融法律法规,制约金融决策、规范金融市场,以促使离岸金融市场长期稳定、健康发展。Construction and development of international offshore financial center can be classified into the naturally -formed type and the policy -motivated type, and each plays a different role in promoting economic development. In the countries where a model of policy - motivated offshore financial center is adopted, such malpractices as administrative power expanded and abused, administrative regulation altered to control or shelter are exposed during the developing course. Therefore, it＇ s compulsory for China in setting up financial law - dominating policy - motivated offshore financial center to maintain the central status of financial laws, to restrict financial decision - making and to normalize financial market by exploiting financial laws and regulations so as to promote a long - run, stable and healthy development of offshore financial centers.
