摘　　要：格式合同的出现极大地促进了整个社会效率的提高,大大节省了社会交易费用,节约了交易时间,使得经济流转迅速、简捷。正如一个硬币也有两面,格式合同自身存在的缺陷也是不容忽视的,在带给社会便利的同时也对合同一方当事人的权益形成了威胁和损害,形成事实上不平等的情形。如何对格式合同的缺陷加以法律规制,目前的法律规制有何不足之处,是值得探讨的问题。The come forth of format contract greatly promote the efficiency of the whole society, save the social transaction cost and transaction time, and make the turnover of economy faster and easier. However, just as a coin has two sides, the limitation of the contract cannot be neglected. While providing convenience to the society, the contract gives threaten and damage to the fights and interests of the party concerned, which form inequality situation in reality. How to give legal regulation to the limitation of format contract, and what are the defects of present legal regulation are topics worth discussing.
