农民集体土地所有权多元行使主体研究

摘　　要：“农民集体”作为集体土地所有权的主体,是否能直接行使集体土地所有权或集体土地所有权到底由谁来代表集体土地所有权主体行使,在当前理论界和实践中是个模糊不清的问题,很有必要进行理论探讨和法律界定。目前,农民集体还不是民法上的民事主体,且农民集体内无业务执行机关。笔者认为,应明确界定农民集体土地所有权多元行使主体:(1)农民集体集体土地所有权的行使主体为乡(镇)农村集体经济组织、村集体经济组织、组农村集体经济组织;(2)农民集体土地所有权代行使主体为乡(镇)人民代表大会、村民委员会、村民小组;(3)农民集体土地所有权委托代理行使主体为村集体经济组织或者村民委员会。Whether 'farmer collectivity',as the principle of collective land ownership,can directly perform collective land ownership and who will represent the principle to perform the the collective land ownership are the obscure problems in the current theory circles.Therfore it is necessary to has a theoretical discuss and legal confirmation.At present,farmer collectivity is not related to civil subject of civil law and there is no business execution department in it.The author thinks it necesarry to confirm the multivariate perform subject of farmer collective land ownership: first,the perform subject should be or town farm collective economic organization,village farm collective economic organization and group farm collective economic organization;second,the duty perform subject should be town people representative congress,villager committee,vilager groups;third,the perform priciple of agency by agreement should be village economic organization or villager committee.
