摘 要:神判是一种法文化现象,在世界许多民族和地区都曾普遍存在过。神判的方式多样,内容丰富,原始社会的宗教巫术仪式和原始生活习俗是神判的重要来源。神判实质上是一种纠纷解决机制,程序公开、审罚合一、野蛮与文明融为一体、无公诉与私诉之分、标准的不确定性与结果的确定性并存以及原始宗教色彩浓厚是神判的基本特征。神判对审判制度、诉讼制度以及西方国家诉讼的程序至上和宣誓证据有重要的影响,在法律的形成和发展方面,神判的作用也是不可小视的。中国虽然也有神明裁判的遗迹,但其影响却远不及西方。Ged-judging is a phenomenon of legal culture, which has been existed in many regions and countries. It is of various modes and abundant in content, with rehgious wizardry ceremony and customs of primitive society as its essential fountains. In fact, God-judging is a kind of disputes-solving mechanism. The basic characteristics of Gedjudging are: procedure disclosing, unifying of judging and fine, integration of cruelty and civilization, no difference in public prosecution and private prosecution, uncertain standard coexisting with determined results and profound senses of primitive rehgions. Ged-judging has an important influence on trail system, lawsuit system, vowing and so on. When it comes to the formality and development of law, Ged-judging is important, also. There are traces of Ged-judging in China, but it does not influence far as the west.
