论远期支票的效力

摘　　要：从形式层面与实质层面分析,习惯上所称之远期支票并不违背支票的见票即付性。就法律效力而言,远期支票应为有效票据,其票据权利义务应自实际出票之日产生,票载出票日前亦得背书转让。为适应经济发展,我国法律应对远期支票做进一步的明确规定。Either from the formal or from substantial aspect, the generally called post-dated check does not conflict with the fact that a check must be payable on demand. As far as the legal effects are concemed, post-dated checks are valid, and the rights and obligations on checks occur on the true date. The post-dated checks can also be endorsed for transfer before the stated date. In order to regulate the economic development in a better way, our country should make out laws and regulations in details on issues about post-dated checks.
