摘　　要：美国环境公民诉讼作为一项公民诉讼制度,为国内学界所熟知,但往往对其限制条件的研究注意不够。本文通过对美国联邦环境法律中公民诉讼限制条款,包括诉讼范围、诉前通知、行政机关勤勉地实施法律等方面的分析,探究其立法目的,并提出我国环境公民诉讼制度构建的若干具体建议。The American environmental citizen suits provisions, as a public welfare legal regime, have been well known in China＇ s academia but the research of its restraining clauses remains superficial. This paper analyzes the Environmental Citizen Suits Provisions in U. S. A from its litigation scope, notice before litigation, diligent enforcement of bureau to find its legislation purpose, and provides suggestions for litigation constitution of public environmental welfare in China.
