摘　　要：文章从判例法的理论基础和特点入手,分析判例法的借鉴意义,阐述我国建立民商判例制度的作用,论述我国民商判例制度的构建。Starting with the theory foundations and characteristics of the case law, this article analyzes the contributions of the case law to our law system, and then discusses the functions of the design of China＇s civil and commercial case law system, and finally assumes how to establish our country＇s case law system in civil and commercial law.
