摘　　要：总结了我国对商标淡化行为的立法现状,指出了我国的立法现状和司法实践存在的矛盾,从而论证了我国引入商标淡化理论的理论和现实依据。同时,提出我国商标法应当增加关于商标淡化的条款,反不正当竞争法应增加一般条款,以防止驰名商标被淡化。The essay summarizes the legislation actualities about the dilution act,and points out the conflicts between acturlity and practice. Meanwhile,the writer proposes that we should add the term of famous trademark dilution in the trademark law and general clause in the law against unfair competition.
