摘　　要：刑法第407条规定的违法发放林木采伐许可证罪存在主体范围狭窄、行为方式单一和行为对象遗漏的缺陷。从完善立法的需要出发,应将本罪的主体修改为“林业主管部门的工作人员和其他有关主管部门的工作人员”,将本罪的客观方面修改为“违法批准采伐林木或者滥发木材运输证”。There＇re some flaws in the provisions of the Article 407 of the Criminal Law of P.R.C.For instance,the scope of the subjects in the crime of illegally issuing logging licenses is narrow;the act is unitary,and the act target is missing.In order to perfect the legislation,the subject of this crime should be modified to ＂work personnel of departments in charge of forest industry and other relevant authority departments＂,and the objective aspect should be modified to ＂illegally approving logging or indiscriminately issuing licenses of forests transportation＂.
