摘　　要：我国已经加入《联合国反腐败公约》,但我国现行刑法对贪污贿赂犯罪在刑罚设置方面存在着一些与《联合国反腐败公约》内容相脱节的不足之处,这势必影响到对国际社会和我国国内预防和打击腐败的实际效果,因此实有必要结合《联合国反腐败公约》之相关内容对其加以反思和重构。Our country has acceded to 〈United Nations Convention against Corruption〉,which is a good chance consummating the criminal legislation of fighting bribery and corruption crimes in our country, especially there are some disjoints about bribery and corruption crimes＇ punishment setting between our country＇s criminal law and 〈United Nations Convention against Corruption〉, which affect the actual result of fighting corruption in international community and our country. Therefore, it is essential that integrate 〈United Nations Convention against Corruption〉to meditate and reconstruct correlative contents.
