摘　　要：商业秘密作为一种无形而有价值的商业财产,随着科学技术的发展和国际经济竞争的加剧,日益引起人们的关注和重视。时至今日,世界上大多数国家都已经将商业秘密纳入了刑事立法的保护范畴。我国的刑事立法对商业秘密的保护仅仅是初具框架,尚待进一步完善。因此有必要参照和借鉴国外立法的成功经验,进一步完善我国商业秘密刑事立法。Business secret took one kind of valuable commercial property, along with the science and technology development and international economy competition intensifying, arouses people＇s interest day by day and takes, legislator＇s attention changes generally formulates a more suitable universal protection business secret legal system. At this point, in the word the majority country has established has improved the business secret legal protection system, and presents forms the independent economic crimes type, brings into line with the criminal law protection method profit scope the tendency. Our country related business secret criminal legislation has many problems in the judicial practice. From the maintenance socialist market economy order, the safeguard fair competition angle embarks, it is the necessary reference and the model overseas legislation success experience, further consummates our country the criminal legislation.
