论船舶所有权变动涉及第三人的几个问题

摘　　要：《海商法》确立了船舶所有权人的权利保护边界和第三人利益保护的规则,但在保护第三人利益方面仍然存在不少问题。通过论述船舶所有权变动对不同的船舶担保物权人的影响,指出船舶所有权转移时间的确定与第三人利益密切相关,同时对《海商法》的修改提出建议。Chinese Maritime Code establishes the protective limits of rights of the owner of ship and the rules for protecting the third party＇s interest as well. However, there are still many problems from the aspect of protecting the third party＇s interest. This paper detailed the different influences of alteration of ownership of ship on different the third parties. The starting time of transferring of ownership of ship is interrelated to the third party＇ s interest. This paper put forward suggestions on amendments of Maritime Code of P. R. C and the protective system for the third party shall be set up.
